Today’s question is, Is it possible to file bankruptcy with SSI? This person elaborates by writing “I am living solely on my SSI. I don’t know what to do. I feel like suicide is my only option because you can’t get money from a dead person.”

I’m hoping this person still has her sense of humor and isn’t really thinking about suicide. This type of question, “can I file bankruptcy if…..” comes up a lot. The answer is almost universally “YES, you can file.” For this person who is living on SSI, bankruptcy is a clear option. The SSI is exempt from creditors’ claims and doesn’t count in the calculation of Current Monthly Income (“CMI”) under the Means Test.
